This policy explains how data is processed in connection with visits to this website and enquiries sent to Factory AI.

The brief’s fields are processed in your browser. There is no automatic submission to Factory AI and no enquiry database on this website. Downloading creates a file on your device.

When you select “Prepare email to Factory AI”, the content is transferred to a draft in your email application. You can review or discard it; Factory AI only receives it if you send the message. Your email provider may process that draft under its own policy.

3. Data, purposes and legal bases

• Requests for information or a quotation: we process the name and contact details you provide, the content of your message and the business information needed to assess the project. If you request a proposal or steps prior to entering into a contract, the legal basis is taking pre-contractual steps at your request (Article 6(1)(b) GDPR).
• Other business enquiries: we may respond on the basis of our legitimate interest in handling communications related to our business (Article 6(1)(f) GDPR), subject to your right to object where applicable.
• Operation and security: the hosting service processes technical data needed to deliver pages, such as IP address, date, requested resource and browser details, to operate the service and prevent misuse, on the basis of the legitimate interest in maintaining the website’s availability and security (Article 6(1)(f) GDPR).
• Legal obligations: data needed to respond to legal requirements or liabilities is processed under the applicable legal obligation (Article 6(1)(c) GDPR).

Contacting us does not subscribe you to marketing. This website does not include a marketing list or make automated decisions about visitors.

4. Retention

Enquiries are kept for as long as needed to respond to and manage the request. Once an enquiry is closed, data that is no longer necessary will be deleted; where retention is legally required or potential liabilities may arise, it will be retained with access restricted for the applicable statutory periods. If a contractual relationship is established, the retention periods applicable to that relationship will apply.

The local brief remains under your control: you can delete the downloaded file and the email draft. This website does not retain it between visits.

5. Providers and recipients

The website is hosted using Porkbun LLC’s Static Hosting service and its hosting infrastructure. The contact email uses Microsoft infrastructure, according to the domain’s configuration. These providers and, where necessary, support or professional advisory providers may be involved in delivering the service. Data may also be disclosed where legally required.

The hosting and email services may involve processing outside the European Economic Area. Information about the locations and safeguards of these services is available in Porkbun’s privacy policy and Microsoft’s privacy statement. You can ask the data controller for further information about the providers and safeguards applicable to your enquiry.

6. Your rights

You may request access, rectification, erasure, restriction, objection and portability where applicable by writing to info@factory-ai.tech or the address above. Explain your request; additional identification information will only be requested if necessary. Where processing is based on consent, you may withdraw it without affecting the lawfulness of earlier processing.

You may also lodge a complaint with the Spanish Data Protection Agency (AEPD). Rights requests are generally answered within one month; you will be informed if a legally permitted extension is needed.

7. Scope and updates

This policy covers the website and initial enquiries. Data processing within an AI project will be agreed separately, including the necessary instructions and agreements. Significant changes to how this website operates will be reflected in an updated version of this policy.
